TERMS OF SALE

These Terms of Sale ("Terms") govern all purchases made through joeysupplies.com.au or any other sales channel operated by Joey Supplies Pty Ltd (ACN 699 458 207) ("we", "us", "our"). By placing an order with us, you ("Customer", "you") agree to be bound by these Terms. Please read them carefully before purchasing.

2. Orders and Contract Formation

2.1 Placing an Order

An order is placed when you submit a completed purchase request through our website or other approved sales channel and receive an order confirmation from us.

2.2 Acceptance

A binding contract is formed only when we send you a written order confirmation. We reserve the right to decline or cancel any order at our sole discretion, including where:

• a product is listed at an incorrect price due to error;
• we are unable to verify payment;
• the item is out of stock; or
• we reasonably suspect fraudulent activity.

2.3 Order Amendments

Once an order is confirmed, amendments are subject to our approval and may not be possible if the order has already been dispatched.

3. Pricing and GST

3.1 Prices

All prices displayed on our website are in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless otherwise stated. GST of 10% will be added at checkout.

3.2 Price Changes

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price confirmed at the time of your order confirmation.

3.3 GST Invoices

A tax invoice compliant with the A New Tax System (Goods and Services Tax) Act 1999 (Cth) will be issued with each confirmed order.

4. Payment

4.1 Payment Methods

We accept payment by the methods listed on our website at the time of purchase. All payments must be received and cleared before goods are dispatched.

We do not store your credit card or banking details. All payment processing is handled by our third-party payment providers.

4.3 Declined Payments

If payment is declined or reversed after an order is placed, we reserve the right to cancel the order and recover any goods already dispatched.

5. Delivery

5.1 Delivery Areas

We deliver nationally across Australia via our designated freight carrier. Remote or regional areas may incur additional freight charges or extended delivery timeframes, which will be disclosed at checkout.

5.2 Delivery Timeframes

Estimated delivery timeframes are provided in good faith and are not guaranteed. We are not liable for delays caused by our freight carrier, weather events, or other circumstances beyond our control.

5.3 Risk and Title

Risk in the goods passes to you upon dispatch from our facility. Title to the goods passes to you upon receipt of cleared payment in full.

5.4 Delivery Requirements

You are responsible for ensuring adequate access and appropriate equipment for delivery of large items. Additional costs arising from failed or re-attempted deliveries due to your failure to provide adequate access will be charged to you.

5.5 Inspection on Delivery

You must inspect goods on delivery. Any visible damage must be noted on the carrier's delivery docket and reported to us within 48 hours of delivery. Failure to do so may affect your ability to make a claim.

6. Returns and Refunds

6.1 Change of Mind

We do not accept returns for change of mind. Please choose carefully before placing your order.

6.2 Incorrect or Damaged Goods

If you receive goods that are incorrect or damaged in transit, you must notify us within 48 hours of delivery with photographic evidence. We will, at our election, replace the goods or issue a refund.

6.3 Return Process

No goods are to be returned without our prior written authorisation. Unauthorised returns will not be accepted. Return freight costs are your responsibility unless the goods are faulty or incorrect.

7. Warranty

7.1 Manufacturer Warranty

Our products are covered by a 12-month manufacturer warranty against defects in materials and workmanship from the date of delivery. This warranty does not cover:

• fair wear and tear;
• damage caused by misuse, neglect, accident, or improper storage;
• damage caused by use other than in accordance with product instructions;
• damage caused by unauthorised modification or repair; or
• consumable parts.

7.2 Warranty Claims

To make a warranty claim, contact us with proof of purchase and a description of the defect. We will assess the claim and, at our discretion, repair, replace, or refund the affected product.

7.3 Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits or excludes rights that cannot lawfully be excluded under the Australian Consumer Law.

8. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or in connection with these Terms or your purchase is limited to the purchase price paid for the goods in question.

8.2 Exclusion of Consequential Loss

To the fullest extent permitted by law, we exclude liability for any indirect, special, consequential, or incidental loss or damage arising out of or in connection with the supply of goods, including loss of profits, loss of revenue, or business interruption.

8.3 No Exclusion of Statutory Rights

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law or any other legislation that cannot lawfully be excluded or limited.

9. Privacy

We collect and handle personal information in accordance with our Privacy Policy. By placing an order, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

10. Intellectual Property

All content on our website and in our marketing materials, including but not limited to text, images, logos, and product descriptions, is owned by or licensed to Joey Supplies Pty Ltd and is protected by Australian and international intellectual property laws. You must not reproduce, distribute, or use our content without our prior written consent.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under or in connection with these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.

12. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and us in relation to your purchase and supersede all prior representations, agreements, or understandings.
